IMPORTANT INSURANCE INFORMATION
Our Motorhomes are supplied with comprehensive insurance,
however you will be responsible for the first £1250.00 (£1500.00 in some
cases) of any damage caused to the vehicle. What appears to be relatively
minor damage on a Motorhome can cost a lot to replace or repair, therefore
we always advise clients to take out a separate Insurance Excess Insurance
for at least this amount. There are several companies offering excess

Your Motorhome is supplied with comprehensive RAC
breakdown cover for both the UK and Europe, however we strongly advise that
our clients ensure that they have a suitable travel insurance in place from
the time of booking which will cover both personal sickness and accident and
cancellation or curtailment of your booking

Terms and Conditions
- General
Throughout these terms &
conditions 'SYC' refers to the 'Sagittarius Yacht Charter & Motorhome
Hire' company.
These Terms and Conditions will form part of a Contract of Hire of a
motor vehicle (Rental Agreement) between the hirer and the hire
company.

Collecting the motor home
A helpful hint: if
possible, try not to plan a major journey of your holiday on the
same day you collect your vehicle. We need to show you exactly how
to get the most out of your motor home, and this will take some
time. It is essential that the hirer should be given a thorough
introduction to the rental vehicle by our experts before the journey
begins. For insurance purposes a hire ‘start’ time is after the hire
‘end’ time – i.e. if a vehicle is collected at 1pm then it must be
returned by 12 noon, otherwise and additional full days hire
will be charged.
- Cleaning
Your motor home will be supplied in a pristine
condition. We request that it is returned with the interior in the
same condition as when collected. Cleaning equipment and materials are provided free
of charge. If the vehicle is returned in an unacceptable condition an
additional valet charge of £75 will be levied.

Replacement Vehicles
If your chosen motor home is not available, SYC reserves the right to
offer you another vehicle in its place. This may be of similar size to
the vehicle requested or larger, and will be similarly equipped. In
this event, the hirer is not liable for higher rental charges. If a
smaller vehicle is offered and accepted, the difference in charges
will be refunded. If a larger vehicle is offered, SYC is not liable
for additional expenses e.g. higher ferry charges or road tolls.

European & Non European Travel.
The hirer may travel in any European countries by prior agreement. Travel in countries outside Europe is also only
possible after prior agreement with the SYC. Written confirmation from
SYC and an additional insurance premium are required before beginning
the journey. The hirer may not travel in war or disaster zones. Please
note that Turkey is currently not part of Europe.

Collection and Return
Vehicles are available
for weekly hire Saturday to Saturday during high season and any day during low and mid seasons. Short break hire is Friday pm to
Monday am or Monday pm to Friday am. Short break hire is not available
over bank holiday periods. Hiring's start and finish at the SYC depot
unless otherwise agreed. Un-emptied toilets and waste water tanks will
incur a £50 penalty each. SYC reserve the right to impose a £75 valet penalty if the vehicle is returned in
a condition unsuitable for habitation..
- Collection
/ Return Times
Collection times:
3 p.m. to 5 p.m.
Return times:
9 a.m. to 11 a.m.
Collection or return times which fall outside the dates and times
given must be agreed with SYC in advance.
The return of the vehicle is confirmed in writing, signed by the hirer
and the SYC.. Collection and return days are charged as per day..
Since the times for collecting and returning motor homes are carefully
planned, please return your motor home on time. A penalty of £25- per
hour is payable for time between expiry of the rent agreement and the
return of your vehicle (maximum penalty is daily rental charge).
Should the late return of the vehicle make us liable for extra costs
(e.g. compensation of the next hirer), we reserve the right to pass on
these costs to you.
Please return your vehicle on time.

Period of Hire
The times and dates of the contract of hire must be strictly adhered
to
NO REFUND IS GIVEN FOR THE EARLY RETURN OF THE VEHICLE
-
Drivers.
No one other than the drivers named in the insurance proposal form may
drive the hired vehicle.
-
Driving Licenses.
Drivers must be over 25 and under 75 years of age and have held a full
driving license for at least 2 years. In certain circumstances the
lower age limit can be reduced to 21. (Drivers under 25 and over 70
will incur an additional insurance premium charge. Further details
obtainable from SYC.) The license must be unendorsed (except for
speeding and parking offences) and must be produced at the time of
collecting the vehicle. Visitors from abroad must hold a current
international driving permit or license (Foreign license holders will
incur an additional insurance premium charge). Any current
endorsements (within 3 years) will incur an additional insurance
premium charge. 2 Forms of proof of identity (including photo such as
a passport) must be produced by all hirers at the start of the hire
i.e. utility bills, bank statements or credit card statements.

Insurance.
Fully Comprehensive insurance for the UK is included within the hire
charge, however, damage to glass, windscreens and tyres are excluded
from this cover,
and are the responsibility of the hirer. The vehicle is insured for the period of the hire contracted
ONLY, thus late return of the vehicle would incur a traffic offence
under the road traffic act. Hirers are advised to take out
additional personal holiday insurance to cover personal loss,
illness and holiday cancellation. A £1250 excess deposit is payable
by the hirer in cash or bank transfer or credit card (amount
charged on card - there will be a 3.4% surcharge if any excess
damage charge
is made to the card) prior to the commencement of the hire.
Providing the vehicle is returned in the condition as it was
collected then the excess will be returned within 7 days of the end
of the hire, any claim against the insurance will result in the full
or partial loss of the excess deposit any charges for non insured
loss or damage to the vehicle, its equipment or accessories will be
deducted from this deposit or billed at the time of return. The
insurance excess may be increased up to £1500 by the vehicle
insurance company due to the personal circumstances of the hirer /
driver - this decision is outside of the control of SYC. The
hirer must advise SYC of any damage to the vehicle at the
time of occurrence (other than minor breakages or scratches), and
the hirer is required to contact the insurance company and complete
any required paperwork such as claim forms or accident reports
prior to vacating the Motorhome on return to the SYC base. In
certain cases the hirer will be the insurance policy holder and will
be responsible for the completion of any insurance claim procedure
resulting from their hire. The hirer (insured person) authorizes
Christopher Learmonth or other representatives of SYC (vehicle
owners) to discuss, negotiate and action any insurance claims or
matters directly with the insurance company or insurance providers
on their behalf. It is strongly recommended that hirers take out a
separate insurance excess insurance policy to cover the excess
charges including glass and tyres.

Insurance
Excess Insurance.
Repairs to Motorhomes
can be extremely expensive. even for damage that appears to be quite
minor, therefore we strongly recommend clients take out a specific
insurance policy to cover the insurance excess and any damage to
glass & tyres. As part of the conditions of that policy the
insurance must be in place prior to collection of the vehicle
- sight of the policy document will be required on collection, if
the insurance is taken. If damage is sustained to the vehicle during
the hire period, the hirer will be responsible for payment of the
excess damage costs out of their deposited funds. It is the hirers
responsibility to recover this amount from the insurance company from whom the
insurance was purchased, and SYC will supply copies of documents
required, including VAT invoices and 1 estimate for the repairs free
of charge, any unreasonable requests or requirement of a second
estimate will incur an additional service charge. Any excess damage
that was caused by a third party (i.e. not the hirers fault) will
still be treated in the same way and the amount recovered and repaid by the
insurance company. Our web site contains links to an independent
supplier of appropriate insurance, however it is the responsibility
of the hirer to obtain and pay for such insurance either through
World Wide Travel Insurances Ltd or through any other supplier of
suitable insurance. SYC act as introducers for World Wide Travel
Insurances Ltd, only and do not act as agents. Any suggestion of
premiums payable are only given as an indication. All quotes for
such insurance must be obtained direct from the insurers by the
hirer.

Booking Details.
Telephone, email and online reservations can be made, but will only
be held for 5 days, by which time a completed Booking Form and a
deposit of £200 per week of hire should have been received by SYC or
our agents. The booking deposit payment is not refundable under any
circumstances and shall be deducted from the hire charges.
Confirmation of booking will be emailed to you with an invoice in
respect of the balance. Full payment is due 4 weeks before the
commencement of the hire (or with completed booking form if booked
less than 6 weeks before hire). Early booking is advised to avoid
disappointment. SYC is not responsible for the release of any
reserved dates if these conditions are not met.

Payment
Full
payment is due 4 weeks before commencement of the hire (or
with completed booking form if booked less than 6 weeks before hire).
Payment can be made by Sterling cheque, bank transfer in 3
currencies, cash, PayPal, debit card or credit card (3.4% surcharge
for credit card & PayPal transactions).

Credit Card Payments
(a) SYC will accept
payment by credit and Debit cards approved by SYC (b) When payment is paid by credit card, I agree that; 1. SYC is irrevocably authorized to complete any documentation and to
take any other action to recover from my credit card issuer all
amounts due by me pursuant to this Agreement, including but not
limited to, any amounts due in respect to damage to the Vehicle or to
property of a third party and all other additional charges as they are
incurred (including all parking and traffic infringement penalties,
road toll fines, congestion charges, and associated administration
costs); 2. I will not dispute my liability to SYC for any amount due under
this agreement and I shall indemnify and keep indemnified SYC against
any loss incurred (including legal costs) by reason of notifying my
credit card issuer of such dispute. 3. SYC may process the credit card voucher; in the event that SYC
elects to accept payment of the Security Deposit by holding an open
security payment which will be cancelled at the completion of the
Rental Period, I agree that SYC is entitled to recover payment from my
credit card issuer pursuant to paragraph (1) in respect of any amounts
due which were not known at the time of canceling the open security
payment. c) I acknowledge that all credit and debit card transactions under
this agreement are conducted in Pounds Sterling. Due to exchange rate
fluctuations, there could be some variance between the amount
initially debited against my credit card and the amount refunded
within 7 days after the expiration of the rental period. I release SYC
from any liability for such variation.

Cancellation Policy Cancellation of any booking will incur the following charges:

All cancellations must be
made in writing. Any pre-paid insurance excess will be returned
providing there are no outstanding monies due from hire fees or
booking deposit. We strongly recommend that you take out a suitable personal all risk holiday insurance
cover including cancellation as any fees due for hires cancelled after
the 42 day deadline will be payable and collected.
- Security Deposit
A security deposit of £200 will be required prior to removal of
the vehicle from our depot to cover miscellaneous costs or losses
incurred such as motoring fines & fees, refueling, cleaning, missing
equipment etc. This can be paid by cheque (we will not cash it unless
necessary), cash or by authorized credit card (3.4% additional charge
on any amount deducted) Your deposit will be returned / cancelled
after a 6 week post hire period has elapsed less any costs advised to
you.
- Breakdown cover
The
vehicle has full UK breakdown cover. If using the vehicle abroad an
additional cover will be required at additional cost which will
depend on length of hire and countries to be visited. A quote will
be supplied on request, or sight of the hirers’ own documentation
specified to the Motorhome will be required before removal of the
vehicle from the depot.

Breakdowns.
In the unlikely event of a breakdown, SYC request that the hirer seeks
the help of the appropriate breakdown company quoting the registration
number of the vehicle. Hirers are authorized to request repairs up to
the value of £50. Repairs costing in excess of £50 must first be
authorized by SYC PRIOR to the work being undertaken..

The hirer agrees that he or she:
a) shall not carry more passengers than the sleeping capacity of the
vehicle or allow the vehicle to be overloaded
b) Shall not use the vehicle for carrying passengers or goods for hire
or reward
c) Will be responsible to SYC for the cost of making good any loss or
damage to the vehicle, its equipment or accessories caused by improper
use.
d) Understands that he/she is fully responsible for any traffic
offences and fines and parking fines which may be incurred during the
hire period. Non payment of fines will incur a £50 handling
surcharge..
e) Shall not, without prior written consent from SYC, remove the
vehicle out of the UK mainland.
f) Understands that no claim by the hirer for loss or damage to
personal belongings or effects of the hirer or any person or persons
will be considered.
g) Understands that any damage to the interior of the vehicle
(including cigarette burns) living or cooking equipment will be
charged to the hirer in all cases.

SYC reserves the
right to cancel hire if, at the commencement of hire. the drivers
license’s are invalid or not according to any of the conditions set
out in these terms & conditions. In these circumstances the total
hire charge will be forfeited. Hirers are strongly advised to insure
against unavoidable cancellation.
-
Suitable Persons
SYC have the right to refuse to hand over a
Motorhome to any person
who, in the reasonable opinion of SYC is not suitable to take charge
of the vehicle.. In such cases, all hire charges paid will be refunded
in full with the exception of the initial deposit by which SYC do not
have any further liability.
-
Availability
While every effort is made to ensure that the vehicle reserved is
available, if due to circumstances beyond our control, the reserved
vehicle is not available, the company reserves the right to offer a
suitable alternative or a reduction in the hire fee for late
availability. If this is not acceptable, the liability of SYC will be
limited to the return of any monies paid by the hirer.

Liabilities.
The hirer is responsible for all costs and expenses incurred as a
result of offences against the road traffic act and is also liable for
any uninsurable damages including
tyres,
windscreen, and any internal damages or breakages. The hirer will indemnify SYC from any liability.

Vehicle Security.
It
is the hirers responsibility to ensure that the vehicle is securely
locked at all times whilst the vehicle is left unattended. All
valuable items should be concealed from outside view and the TV/DVD
should be stowed, covered or the blinds drawn. Failure in ensuring
this could result in any insurance claim for break in or theft being
void, meaning you will be personally responsible for any damage or
loss caused to the vehicle during a break-in.

Pets.
All hirers must be aware that the motor homes offered for hire may
have had pets in at some time. All pets other than guide dogs have to be approved by SYC at the time
of booking. If approved, all damage howsoever caused by the animals
will be the responsibility hirer and charged in full. If approved, an
additional fee of £20 will be charged for each pet.

Parking.
The hirer may park free of charge and at his/her own risk one car
for the period of the hire.
All
vehicles however are left entirely at your risk and SYC accept no
responsibility for any loss or damage which arises.

Fuel
Our
vehicles run on Diesel. The vehicle will be supplied with a full
tank of fuel. It must be returned to us with a full tank of fuel,
otherwise a charge of £20.00 over the fuel cost will be made for
refueling the vehicle and deducted from your security deposit along
with the cost of fuel. If petrol is put into the fuel tank in error,
the vehicle SHOULD NOT BE STARTED. The cost of removal of the fuel
will be charged to the client as will the refueling with correct
fuel. No refunds will be given for the cost of the removed fuel.
Should the vehicle be started under such circumstances, the hirer
will be responsible for the costs of any mechanical damage incurred.

Gas
Your vehicle comes with 2 Propane gas cylinders, one full and one partially used. Unlike
other hire companies we do not charge you for gas, we just request
that if you empty a cylinder, that you replace it at your cost, and
the vehicle is returned with at least one cylinder full.

European use
The minimum hire period for continental travel is
1 week.

Smoking Our vehicles are
considered as public domain under the new smoking legislation in force
from 1st July 2007, therefore it is illegal to smoke anywhere in the
motor home and is not allowed at any time. Any detected contravention
of this rule will incur a loss of the full security deposit, and could
possibly result in a fine from outside sources.

SYC reserve the right to vary the rates and conditions of hire at any
time and to decline hire to any person at any time without reason,
this includes the right to change or substitute vehicles when
necessary.

Law and Jurisdiction
These Terms
shall be governed by and construed in accordance with the laws of
England and Wales and any disputes will be decided only by the
English courts
All
trademarks and trade names are acknowledged as belonging to their
respective owners. All copyrights of photograph’s and material owned by the
Swift Group Limited used in this web site are acknowledged. All rights reserved.
